What is property insurance Appraisal?

Appraisal is an alternative dispute resolution process provided within most property insurance policies. Appraisal does not determine coverage but can be invoked by either the policyholder or insurance carrier when there is a dispute involving either (or both) the scope of damage or pricing of the repair.

How does the appraisal process work?

Once the appraisal process is invoked as outlined in the insurance policy, each party to the claim, the insurance company and the policyholder select their own appraiser to represent them in the dispute. The role of the appraisers is to reach an agreement regarding the amount of the loss. Should the appraisers be unable to reach an agreement, they, or the court if they cannot agree, will name a neutral umpire to resolve the dispute. The two appraisers and the umpire are referred to as the “Panel”. An award listing the policy coverages with dollar amounts representing the amount of loss. The amounts on the award are supported by an accompanied estimate which outlines the cost to repair or replace the damaged property. An award is considered final when it is signed by at least two of the panel members. The final award is binding with respect to the amount of the loss. The insurance policy or state law may govern the binding effect of the appraisal award.

What is the umpire's role in a property insurance Appraisal?

An umpire is a neutral third party who will be the one to ultimately resolve any disagreements between the two appraisers. Should the appraisers be unable to reach an agreement, they will select the umpire. The umpire is either agreed upon by the two appraisers, or if they are unable to agree to an umpire, may be named by the court. Each appraiser will provide the umpire his/her “position”, which is an estimate of what they believe is the amount of the loss. The umpire will review each position to determine what is in dispute, then rule on the differences between the two positions. The umpire will create an award listing the policy coverages and amounts representing the cost of repairs or replacement of the damaged property, which will be provided to the appraisers for review. The award requires at least two of the three panel members’ signatures to be considered “executed” and binding (the insurance policy or state law may govern the binding effect of the award).
